On March 15, 2020, I issued an Emergency Declaration in response to the COVID-19 pandemic pursuant to Minn. Stat. Saint Paul Leg. The Planning Administrator, through the Director of the department of planning and economic development, in continuing response to the directive in the Emergency Declaration, has advised that certain City zoning ordinances require zoning permit applicants to first obtain the consent of owners of property located near the zoning applicants property in order for their zoning applications to be considered by the City. Although onditions have improved, threats to public safety remain. WHEREAS, according to the Minnesota Department of Employment and Economic Developments (DEED) most-recent data on the impact of COVID-19: WHEREAS, according to the Center on Budget and Policy Priorities COVID-19 Hardship Watch, [w]hile the economy has added jobs in recent months, there were still 5.0 million fewer jobs in September 2021 than in February 2020. 12.31, Subd. Code Chapter 13.06(b) provides that, whenever necessary to meet an emergency the mayor may by executive order promulgate regulations for which adequate regulations have not been adopted regarding the conduct of persons and the use of property during emergencies, and respecting all other matters which are required to protect public safety, health and welfare in emergencies; and, WHEREAS, on March 16, 2020, Minnesota Governor Tim Walz issued Executive Order 20-04 which ordered the temporary closure of Minnesota restaurants and bars to dine-in customers and also ordered the temporary closure of places of public accommodation and amusement, including but not limited to: theatres, museums, fitness centers, and community clubs; and Bars, taverns, brew pubs, breweries, microbreweries, distilleries, wineries, tasting rooms, clubs, and other places of public accommodation that offer alcoholic beverages for on-premises consumption until April 10, 2020; and, WHEREAS, on March 25, Governor Walz signed Executive Order 20-20 directing Minnesotans to stay at home and allowed only essential workers to go to work. Pursuant to Chapter 13 of the Saint Paul Legislative Code, the above-listed Executive Orders remain in effect upon my signature and, if not sooner rescinded or later extended, shall expire at the end of forty (40) days after the effective date or at the end of the declared local emergency to which they relate, whichever occurs first. The receipt shall disclose, in plain and simple language and in a conspicuous manner: (i) the menu price of the food; (ii) any sales or other tax applied to the transaction; (iii) any delivery charge or service fee, imposed on and collected from the customer by the Third-party Food Delivery Platform and by the Food Establishment, in addition to the menu price of the food; (iv) any tip/gratuity that will be paid to the person delivering the food, and not to the Third-party Food Delivery Platform, that was added into the transaction when it occurred, and (v) any commission associated with the transaction as referenced in paragraph 3 of this emergency executive order, not including any agreed-upon higher commission or fee for access to additional advertising or other products or services. I request that the Saint Paul City Council take immediate action by Ordinance to delay the effective date of Saint Paul Legislative Code Chapter 236 until January 1, 2022 so all impacted businesses will be given an additional year to comply with the provisions of Saint Paul Legislative Code Chapter 236. Any location providing COVID-19 vaccinations or testing provided that the facility follows all supplemental COVID-19 safety measures. On March 25, Governor Walz signed Executive Order 20-20 directing Minnesotans to stay at home and allowed only essential workers to go to work. In accordance with the CDC's recommendation, the Minnesota Department of Health recommends that in order to protect the public's health and slow the rate of transmission of COVID-19, the following events should be postponed or canceled across the state of Minnesota: events where fifty (50) or more people would gather, smaller events (fewer than 50 people) that are held in crowded auditoriums, rooms, or other venues that do not allow social distancing of 6 feet per person, and events with more than IO people where the majority of participants are at higher risk for severe illness from COVID-19. On May 13, 2020, Governor Walz issued Executive Order 20-25 extending the peacetime emergency declared in Executive Order 20-10 through June 13, 2020; and, WHEREAS, during the COVID-19 peacetime emergency, I have exercised executive authority through more than ten Executive Orders to provide relief and further prepare our City for the COVID-19 Pandemic; and. I, Melvin Carter III, Mayor of the City of Saint Paul, on April 9, 2020, pursuant to Saint Paul Legislative Code Section 13.06, do hereby issue the following Executive Order: On March 15, 2020, Saint Paul Mayor Melvin Carter issued an Emergency Declaration in response to the COVID-19 pandemic pursuant to Minn. Stat. Delaying the effective date of the Ordinance until January 1, 2022 may assist the affected businesses in the survival and recovery process. Studies have indicated and public health experts have concluded that indoor dining is a significant driver of the COVID-19 pandemic, in part because it is not possible to wear a mask while eating or drinking. As of February 24, 2021, there have been 481,000 reported cases of COVID-19 in Minnesota, and 6,511 deaths; and, WHEREAS, during the COVID-19 peacetime emergency, I have exercised executive authority through more than 50 Executive Orders to provide relief and further prepare our City for the COVID-19 Pandemic; and, WHEREAS, the National Center for Disease Control and Prevention and the Minnesota Department of Public Health continue to recommend social distancing, source-control and cleaning measures, detailed plans for businesses, and that any individual with confirmed COVID-19 should remain under home isolation precautions until the risk of secondary transmission to others is thought to be low; and, WHEREAS, during this pandemic, it is possible that individuals who are not diagnosed with COVID-19 will be placed in quarantine to control or prevent further spread of COVID-19; and. . On March 15, 2020, Saint Paul Mayor Melvin Carter issued an Emergency Declaration in response to the COVID-19 pandemic pursuant to Minn. Stat. Individuals, regardless of vaccine status, at City-Controlled Property: Must wear a face covering indoors at all times. 12.29; which the City Council consented to on March 17, 2020, and which has been extended and remains in effect; and, WHEREAS, Saint Paul Leg. As of August 20, 2021, there were 55,016 reported cases of COVID-19 in Ramsey County, and 917 COVID-19 related deaths; and, WHEREAS, due to a reversal in the downward trajectory of cases including a national moving average of cases per week in late June of 12,000, to a weekly average of over 60,000, on July 27, 2021, CDC released updated guidance on the need for urgently increasing COVID-19 vaccination coverage and a recommendation for everyone in areas of substantial or high transmission to wear a mask in public indoor places, even if they are fully vaccinated; and, WHEREAS, Ramsey County is in the high transmission category: and, WHEREAS, new data began to emerge in July that the Delta variant was more infectious and was leading to increased transmissibility when compared to other variants, even in vaccinated individuals; and, WHEREAS, the delta variant is more contagious than previous variants, may cause more severe illness than prior variants, and fully vaccinated people with Delta variant breakthrough infections can spread the virus to others; and, WHEREAS, the now 17-month health emergency has impacted the residents and businesses of Saint Paul; and. Any specific regulations for individual City-controlled spaces will be published on the City website and posted at each location. According to SP-RCPH, data available as of June 1, 2021 show that: These promising public health metric trends combined with ongoing efforts to increase vaccination rates across the City of Saint Paul with SP-RCPH demonstrate progress toward ending this pandemic. In subsequent months, the decline in metropolitan areas continued to exceed the decline outside of metropolitan areas; and, WHEREAS, according to the Center on Budget and Policy Priorities COVID-19 Hardship Watch, [w]hile the economy has added jobs in recent months, there were still 5.0 million fewer jobs in September 2021 than in February 2020. 12.29; which the City Council consented to on March 17, 2020, and which I have extended on several occasions; and, WHEREAS, Saint Paul Leg. Any Establishment (defined as a restaurant, bar, general retail, outdoor commercial use, farmers market, brew-on-premise store, or outdoor garden center operating in the City of Saint Paul) that wishes to operate or expand its use on to outdoor public or private property must comply with Governor Walz Executive Order 20-63, the Minnesota Department of Employment and Economic Development industry guidance for safely reopening, the Americans with Disabilities Act, the Minnesota State Building Code, all other laws and regulations, and ordinances not affected by this order. NOW, THEREFORE, I, Melvin Carter III, Mayor of the City of Saint Paul, do hereby renew the following Emergency Executive Order in order to keep the current Skyway Hours in place: Pursuant to Chapter 13 of the Saint Paul Legislative Code, the above listed Executive Order will remain in effect upon my signature and, if not sooner rescinded or later extended, shall expire at the end of forty (40) days after the effective date or at the end of the declared local emergency to which they relate, whichever occurs first. Such establishments are encouraged to offer food and beverage using delivery services, window service, walk-up service, drive-through service, or drive-up service. Executive Order 2020-5, Executive Order 2021-24 (allowing inactive business licenses), Executive Order 2020-38 (waiver of zoning requirements for emergency shelters), Executive Order 2021-3 (regulating third-party food platforms), Executive Order 2021-22 (waiving requirements for certain outdoor uses). On May 29, 2020 the Saint Paul Fire Chief reported that between May 28, 2020 and May 29, 2020, the City received over 300 calls for service for fires, 126 of which were related to fire calls and 55 of which were confirmed. Code Sec. Code Chapter 13.06(b) provides that, whenever necessary to meet an emergency the mayor may by executive order promulgate regulations for which adequate regulations have not been adopted respecting all other matters which are required to protect public safety, health and welfare in emergencies. In Saint Paul overnight on April 11 and into April 12, 2021 there were arson fires, seven Saint Paul businesses were damaged and/or looted, and four individuals were arrested. The WHO and the U.S. Centers for Disease Control and Prevention have advised all individuals to take measures to reduce their risk of COVID-19, especially the Delta and Omicron variants, including proven public health and social measures such as wearing well-fitting masks, hand hygiene, physical distancing, improving ventilation of indoor spaces, avoiding crowded spaces, and getting vaccinated. All remaining and applicable executive orders and associated guidance issued by Ramsey County, the State of Minnesota and/or CDC relative to the wearing of face coverings continue to have full force and effect within the City of Saint Paul. Section 140.10 (a) of the Saint Paul Legislative Code pertaining to the general hours of skyway operation is hereby amended during the current emergency to allow an individual with responsibility for a portion of the skyway system to close their portion of the skyway for which they are responsible at 7:00 p.m. provided that notice of the revised skyway hours are posted in conspicuous locations. I, Melvin Carter III, Mayor of the City of Saint Paul, on March 27, 2020, pursuant to Saint Paul Legislative Code Section 13.06, do hereby issue the following Executive Order: The Novel Coronavirus Diseases 2019 (COVID-19), a respiratory disease that can result in serious illness or death caused by the SARS-CoV-2 Virus, is a new strain of coronavirus not previously identified in humans and can easily spread from person to person. Declares that Executive Order 20-24 is hereby rescinded and replaced by this order. I, Melvin Carter III, Mayor of the City of Saint Paul, on October 18, pursuant to Saint Paul Legislative Code Section 13.06, do hereby issue the following Executive Order: WHEREAS, even though the spread of COVID-19 has slowed, and vaccinations are becoming widely available, serious threats to health and safety of persons and other impacts of the COVID-19 pandemic continue to be felt in the City; and. Also, about half of workers who personally lost wages during the pandemic (49%) are still earning less money than before the coronavirus outbreak started; and, WHEREAS, due to the present economic crisis, as articulated above, it remains necessary for the City to provide economic support to individuals and businesses alike to ensure that Saint Paul recovers from the COVID-19 pandemic disaster; and, WHEREAS, during the COVID-19 peacetime emergency, I have exercised executive authority through more than 111 Executive Orders to provide relief and further prepare our City for the COVID- 19 Pandemic; and, WHEREAS, these Executive Orders remain in effect only as long as the emergency continues; and. COVID-19 infection is transmitted predominately by inhalation of respiratory droplets and studies show that masks and face coverings block the release of respiratory droplets into the environment and can also reduce the wearers exposure to droplets from others because COVID-19 viral particles spread between people more readily indoors and when people are closer together for longer periods of time indoors. Code. The 3-2 vote bucked the superintendent's recommendation to lift the requirement as long as case levels remain low. The positivity rate in Ramsey County is currently more than 13%. Employees who are not in a congregate setting and are alone in their assigned workspace may refrain from wearing a face covering. This civil unrest included mass protests in Minneapolis on May 26-28, 2020 which caused injuries, looting and the destruction of public and private property.
